Scope
Use the Spain Passport for current structured rules
Long-term, seasonal and tourist rentals are different categories. Regional and municipal licences, community-of-owners consent and the current post-judgment national framework must be checked for the exact address.
OwnASea separates national law, autonomous-community taxes, municipal rules, immigration, tourism, banking, registry, Catastro and succession evidence. Under-review values remain pending and are never reduced to a verified yes/no claim.

Regional licence and HOA consent are distinct from the former national registry workflow
For affected tourist rentals, Article 17.12 uses a double 3/5 threshold of owners and participation quotas, with a conditional grandfathering rule for compliant pre-3 April 2025 activity. The Supreme Court’s 2026 judgment annulled parts of the national single-registry procedure; do not display the old national number workflow as current.

What to remember
- NIE is a tax/identity identifier, not a residence permit or TIE.
- Registro de la Propiedad and Catastro answer different questions.
- ITP/TPO, IVA/AJD and Canary IGIC depend on transaction and location.
- Property ownership is not a current Spanish Golden Visa or citizenship route.
- Tourist rental needs regional/municipal compliance plus the HOA layer where applicable.
- Bank products are not a national mortgage average and the 3% Model 211 retention is not final tax.
